These Terms of Use (“Terms”) govern your access to and use of the marketing platform and related services (“Services”) provided by Guardian Credit Union (the “Credit Union,” “we,” “us,” or “our”). By your registration for the Services, you agree to be bound by these Terms, our Privacy Policy (attached hereto and incorporated by reference), and all other applicable agreements between you and the Credit Union, including without limitation our agreements governing deposit accounts and services.

  1. By providing your contact information and enrolling in the Services, you expressly consent to receive marketing, promotional, and informational communications from the Credit Union and its affiliates. Such communications may be delivered via email, telephone, postal mail, text message (SMS/MMS), push notifications, or other means, using the contact information you have provided. You acknowledge that message and data rates may apply to text/SMS messages, and that the frequency of such messages may vary. You may opt out of receiving marketing communications at any time by following the instructions provided in the communication or by contacting us directly.
  2. The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee that the Services will be error-free, uninterrupted, timely, secure, or that defects will be corrected. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
  3. Our Privacy Policy describes how we collect, use, and share your personal information. The Privacy Policy is attached to these Terms and incorporated by reference. By using the Services, you acknowledge that you have received, read, and understood our Privacy Policy.
  4. To the maximum extent permitted by applicable law, the Credit Union and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Services, even if we have been advised of the possibility of such damages.
  5. We may modify these Terms at any time. If we make material changes, we will notify you as required by law. Your continued use of the Services after the posting of revised Terms constitutes your acceptance of the changes.
  6. We may suspend or terminate your access to the Services at any time for any reason, including if we believe you have violated these Terms. Termination will not affect any rights or obligations accrued prior to termination.
